Low Speed Accidents - Correlating Vehicle Impact Speeds Using Collision Damage Analysis and Expected Injuries

As was presented in the paper listed above, also posted on this site, it is not possible to correlate injuries to vehicle damage. Just having this information does not solve the problem of how to get it front of a jury. Typically, the economics of soft tissue injury cases are such that it is not feasible to retain an expert to review the file and make the presentation. Expert witnesses may charge several thousand dollars. Being unable to present their own expert, or to utilize expert consultation to prepare to cross-examine, litigating these cases has been virtually impossible for plaintiff's attorneys.

Case review, consultation and appearance at trial - anywhere in the U.S.

The details -

1. You send the file to Harris Technical Services. Send the traffic accident report, photographs of all involved vehicles, depositions and statements of drivers, passengers and at-scene witnesses and the deposition and/or written report by the defense expert(s). After a review, you will be advised if the case is acceptable to us.

2. If it is not acceptable, the entire file is returned and you have no further obligation and owe nothing. If it is accepted, you will be advised and given the opportunity to accept or reject our offer. If you decide not to use us, there is no charge and no obligation. If you would like to retain us, we will begin to determine the required travel dates and expenses for the appearance.

3. Once a trial appearance date is established, we will check for the most economical airline fare if the trial is outside our local travel area (south and central Florida). A best estimate will be obtained for local lodging, highway tolls, rental car or taxi service as required. Airport parking, at West Palm Beach International Airport or Orlando International Airport, is $15.00 per day. These are travel expenses. There is no charge for meals or incidentals. A retainer equal to the amount of the estimated travel expenses must be received before travel begins. In lieu of a full expense retainer, a round-trip airline ticket may be provided with a retainer for the remaining expected expenses.

4. Up to two days at the trial location will be allowed. The day of travel to the trial location is not included in the two days allowed for the trial appearance.

5. The fixed fee for file review, telephone consultations, meetings, round-trip travel and trial appearance is $1000.00. This fixed fee arrangement is not contingent upon the outcome of the trial. This is for round trip travel and up to two full days at the trial location. There is no discount of the fixed fee for less than the two days allowed at the trial location. Additional days beyond the allowed two days at the trial location, are charged at $250.00 per day with accompanying expense charges.

6. Payment of the time charges and direct expenses incurred above those estimated and received in the initial expense retainer must be received within 30 days after the trial appearance. A fixed fee of $1000.00, plus travel expenses, is charged once travel commences even if there is no trial appearance.
